Action for cancellation and registration of title

The action for cancellation and registration of title seeks the cancellation of a land registry record that is wrongful or does not reflect the true legal position, and registration of the property in the name of its real owner. It is among the strongest remedies protecting ownership under Turkish law.

Transfers made through forged powers of attorney or fraud, lack of capacity, deception, collusive transactions aimed at defeating heirs, and claims based on acquisitive prescription are the principal grounds. The action is filed with the court where the property is located and directed against the registered owner or their heirs.

Claims founded on ownership are in principle not subject to limitation periods, although protection of good-faith third parties relying on the register may affect the outcome. Seeking a preliminary injunction to block transfers during the proceedings is common practice.
