Contract for work (works contract)

An agreement in which a contractor undertakes to produce a specific result and the client undertakes to pay a price for it.

All terms

Under Turkish law, a contract for work obliges the contractor to produce a specific result and the client to pay a price for it. The work may be a physical structure such as a building, or an intangible product such as software, architectural plans or a dental prosthesis.

Its defining feature is the promise of a result: the contractor owes not mere effort but delivery of the agreed outcome. Construction agreements, including land-for-flats arrangements, are the most litigated form of this contract in practice. The price may be fixed as a lump sum or calculated according to the work performed.

If the delivered work is defective, the client may demand repair, a price reduction or rescission, provided the work was inspected and defects were notified within a reasonable time. Failure to notify results in the work being deemed accepted.
