Loss-of-support damages (wrongful death)

Compensation claimed by those who lose the financial support a deceased person provided to them during their lifetime.

All terms

Under Turkish law, loss-of-support damages compensate persons who were financially supported by someone whose death was caused by a wrongful act. The claim rests not on inheritance but on actual support received, so even a life partner without an official marriage may qualify where the conditions are met.

The claim typically arises from fatal traffic and workplace accidents. Spouses, children and parents maintained by the deceased are the usual claimants. Courts calculate the award with expert assistance, considering the deceased's income, the expected duration of support and the ages and life expectancies of the dependants.

The right belongs personally to the dependants, not to the estate; renouncing the inheritance therefore does not bar the claim. In deaths covered by compulsory motor insurance, the claim may also be directed against the insurer of the vehicle at fault.

Miras payı ile karıştırılmamalıdır: miras ölenin malvarlığının geçişidir, bu tazminat ise destekten yoksun kalanların kendilerine ait bağımsız bir alacağıdır.
