A unilateral declaration that brings an ongoing contractual relationship to an end with effect for the future only.
All termsUnder Turkish law, termination (fesih) is a unilateral declaration by which one party ends a contractual relationship with effect for the future. It applies to continuing relationships such as leases, employment and subscriptions: rights and debts already accrued remain valid, and only the future relationship ends.
Termination may be ordinary or extraordinary. Ordinary termination requires no reason but must respect the notice periods set by law or contract. Extraordinary termination requires just cause making continuation intolerable, and takes effect immediately.
The declaration produces effect only once it reaches the other party. For evidentiary reasons, termination is typically communicated in writing or through a notary notice.
Sözleşmeden dönme ile karıştırılmamalıdır: dönme sözleşmeyi geçmişe etkili olarak ortadan kaldırır ve verilenlerin iadesini gerektirir, fesih ise yalnızca geleceğe etkilidir.
