Property and lease

Lease agreement

A contract in which the lessor undertakes to leave the use of a thing to the lessee, who undertakes to pay the agreed rent in return.

All terms

A lease agreement obliges the lessor to leave the use, or the use and enjoyment, of a thing to the lessee, who in return pays the agreed rent. Residential and roofed workplace leases in Türkiye are subject to special tenant-protective provisions.

No particular form is required; an oral lease is valid, though written form matters for proof. In residential and roofed workplace leases, rent increases are capped by the average change in the consumer price index of the previous lease year; fixed-term contracts are deemed extended unless the tenant gives notice, and the landlord cannot end the lease merely because the term has expired.

The landlord may terminate only on grounds listed by statute and generally through court action, the eviction grounds being exhaustive. Clauses disadvantaging the tenant contrary to the statute are void, so not every provision written into a lease is actually binding.
