Mesne profits (ecrimisil)

Ecrimisil is compensation owed to the owner by a bad-faith possessor who has used immovable property without legal justification, comparable to mesne profits. It rests on the provisions governing restitution by possessors not in good faith and has been shaped by Turkish case law.

Typical settings include one heir using jointly owned property alone, tenants remaining after the lease has ended, and structures encroaching on a neighbouring parcel. The amount is generally measured by the property's comparable rental yield and may be claimed retrospectively within the statutory limitation period.

In claims between co-owners, courts require prior objection to the exclusive use, meaning the claimant must have communicated the wish to benefit from the property; no compensation is awarded for periods before that condition is met. For occupied Treasury land, the administration collects the compensation through its own notice procedure.
