Usufruct

Usufruct (intifa hakkı) is a servitude granting its holder full enjoyment of property belonging to another. The holder may use the property, lease it out and collect its fruits, while the owner retains what is called bare ownership.

Over immovables, the right is created by registration in the land registry. In Turkish practice it most often appears where parents transfer property to their children while reserving a usufruct for themselves to secure lifelong residence and income. For natural persons the right ends at the latest upon death; it cannot be transferred or inherited, although its exercise may be left to another.

Buying property burdened with a usufruct means the buyer cannot benefit from it until the right ends; the burden is visible on the title record and significantly affects the property's value.
