With the amendment made by the International Civil Aviation Organization (“ICAO”), the liability amounts regulated under the Convention for the Unification of Certain Rules for International Carriage by Air (“Montreal Convention”) have been updated as of 28 December 2024. Signed on May 23, 1999, and entered into force on November 4, 2003, the liability limit regulations under the Montreal Convention were updated in 2009 and 2019. With the December 28, 2024, Amendment on International Air Carriage Liability Limits by Year, the current limits of liability are as follows:
Article 21
The limit of liability for death or bodily injury increased from SDR 128,821 to SDR 151,880.
Article 22/1
The limit of liability for delay in passenger transportation increased from SDR 5,346 to SDR 6,303.
Article 22/2
The limit of liability for destruction, loss, damage, or delay of baggage has increased from SDR 1,288 to SDR 1,519.
Article 22/3
The limit of liability for destruction, loss, damage, or delay of cargo has increased from SDR 22 to SDR 26.
Scope of Limits of Liability
The limits of liability set by the Montreal Convention are the limits applicable to international air transportation. In this context, the limits set by the Montreal Convention are binding only for international flights. The countries’ domestic law regulates the limits of liability applicable to domestic flights.
