A

Action for annulment of objection A lawsuit in which the creditor asks the court to find the debtor's objection unjustified so that the halted enforcement can continue. Action for discharge of debt Borçtan kurtulma davası, itirazın geçici olarak kaldırılması kararı verilen borçlunun, borçlu olmadığının tespiti amacıyla yedi gün içinde genel mahkemede açtığı davadır. Action to set aside fraudulent transfers A lawsuit rendering transfers made by the debtor to defeat creditors ineffective as against the claimant creditor. Annulment of enforcement auction An application to the enforcement court for annulment of a forced sale due to irregularities, suspending the auction's consequences. Attachment (seizure) The legal seizure of the debtor's assets and rights by the enforcement office, in a finalised proceeding, to satisfy the creditor's claim. Auction price İhale bedeli, icra dairesince yapılan açık artırmada malın üzerinde kaldığı alıcının ödemekle yükümlü olduğu ve satıştan elde edilen parayı oluşturan artırma bedelidir.

B

Bankruptcy A collective enforcement procedure in which the debtor's entire attachable estate is liquidated to satisfy all creditors together. Bankruptcy administration İflas idaresi, birinci alacaklılar toplanmasınca seçilerek icra mahkemesince atanan ve iflas masasını temsil edip tasfiye işlemlerini yürüten üç kişilik tasfiye organıdır. Bankruptcy estate İflas masası, iflasın açılmasıyla birlikte borçlunun nerede bulunursa bulunsun haczi kabil bütün malvarlığının, alacaklıların topluca tatmini amacıyla oluşturduğu hukuki mal topluluğudur. Breach of payment undertaking The debtor's failure, without reasonable cause, to honour a payment undertaking given in enforcement, sanctioned with coercive detention.

Certificate of insolvency An official document recording that enforcement failed to satisfy the claim in whole or in part, granting the creditor special facilities. Composition with creditors (concordat) A court-supervised mechanism allowing a financially distressed debtor to restructure debts through an arrangement with creditors. Concordat commissioner Konkordato komiseri, geçici veya kesin mühlet kararıyla birlikte mahkemece atanan, borçlunun faaliyetlerini denetleyen ve konkordato projesinin uygulanabilirliği hakkında mahkemeye rapor sunan görevlidir. Concordat moratorium Konkordato mühleti, borçluya alacaklılarıyla anlaşma sağlayabilmesi için asliye ticaret mahkemesince verilen ve bu süre boyunca aleyhine takip yapılmasını kural olarak engelleyen koruma süresidir. Court-appointed custodian (judicial trustee) The trusted person or entity to whom attached or seized property is entrusted for safekeeping until sale or resolution of the dispute. Custody measure Muhafaza tedbiri, haczedilen taşınır malların satışa kadar değerinin korunması amacıyla icra dairesince muhafaza altına alınması veya bir yediemine teslim edilmesi işlemidir.

Declaration of assets Mal beyanı, borçlunun gerek kendisinde gerek üçüncü kişilerde bulunan mal, alacak ve haklarıyla gelirlerini borcuna yetecek ölçüde yazılı ya da sözlü olarak icra dairesine bildirmesidir.

Enforcement auction (forced sale) The sale of attached or pledged assets by the enforcement office through public auction in order to satisfy the creditor's claim. Enforcement civil court İcra hukuk mahkemesi, icra ve iflas dairelerinin işlemlerine karşı yapılan şikâyetler ile itirazın kaldırılması gibi takip hukukuna özgü uyuşmazlıkları basit usulde inceleyen mahkemedir. Enforcement criminal court İcra ceza mahkemesi, İcra ve İflas Kanunu'nda düzenlenen taahhüdü ihlal ve gerçeğe aykırı beyan gibi takip hukukuna özgü suç ve kabahatleri şikâyet üzerine yargılayan mahkemedir. Enforcement denial compensation İcra inkâr tazminatı, ödeme emrine haksız yere itiraz eden borçlunun, itirazın iptali veya kaldırılması üzerine alacaklıya ödemekle yükümlü tutulduğu kanuni orandaki tazminattır. Enforcement of court judgments The enforcement route based on court judgments or documents deemed equivalent, which the debtor cannot halt by simple objection. Enforcement order İcra emri, ilama veya ilam niteliğindeki belgeye dayanan takiplerde borçluya tebliğ edilen ve borcun kanunda öngörülen süre içinde yerine getirilmesini ihtar eden icra dairesi işlemidir. Enforcement proceedings (debt collection proceedings) The statutory process by which a creditor collects an unpaid debt through the enforcement office, using the coercive power of the state. Enforcement specific to negotiable instruments An accelerated enforcement route reserved for claims based on bills of exchange, promissory notes and cheques, with stricter objection rules. Enforcement through realisation of pledge Rehnin paraya çevrilmesi yoluyla takip, alacağı taşınır rehni veya ipotekle güvence altına alınmış alacaklının, önce rehinli malın satışını sağlamak üzere yürüttüğü icra takibidir. Enforcement with eviction claim Tahliye istemli takip, kira bedelinin ödenmemesi veya kira süresinin sona ermesi nedeniyle kiraya verenin, kiralananın boşaltılmasını icra dairesi aracılığıyla istediği ilamsız takip yoludur. Enforcement without judgment An enforcement route for money and security claims that may be initiated directly at the enforcement office without any court judgment.

G

Garnishment notice (third-party attachment notice) The official notice sent to third parties to attach the debtor's claims and assets held by them, producing escalating legal consequences. General attachment procedure Genel haciz yolu, rehinle güvence altına alınmamış ve kambiyo senedine dayanmayan para alacakları için izlenen, ödeme emri tebliği ile başlayan ilamsız takip yoludur.

Late objection Gecikmiş itiraz, kusuru olmaksızın süresinde itiraz edemeyen borçlunun, engelin ortadan kalkmasından itibaren üç gün içinde icra mahkemesine başvurarak yaptığı ve kabulü hâlinde takibi durduran itirazdır.

N

Negative declaratory action A lawsuit in which the apparent debtor asks the court to declare that no debt exists or that the debt has been extinguished. Non-attachable property Haczedilemeyen mallar, borçlunun ve ailesinin yaşamını sürdürebilmesi için kanunla haciz dışında bırakılan, tamamı veya bir kısmı üzerinde cebri icra uygulanamayan mal, hak ve gelirlerdir.

O

Objection to payment order The debtor's declaration to the enforcement office, within the statutory period, that they dispute the debt or the signature in the payment order. Objection to the debt Borca itiraz, ödeme emri tebliğ edilen borçlunun borcun bulunmadığını veya istenen tutarda olmadığını ileri sürerek takibi durduran ve yedi gün içinde yapılması gereken beyanıdır. Objection to the signature İmzaya itiraz, adi senede veya kambiyo senedine dayalı takipte borçlunun, senet altındaki imzanın kendisine ait olmadığını ayrıca ve açıkça ileri sürmesidir.

P

Payment order The official enforcement document served on the debtor at the start of proceedings, stating the debt, the right to object and the deadlines. Payment undertaking in enforcement The debtor's formal declaration before the enforcement office undertaking to pay the debt in instalments on specified dates. Provisional attachment The precautionary seizure of the debtor's assets by court order, for due money claims, against the risk of assets being dissipated.

R

Ranking schedule of creditors The list showing the order of priority in which creditors share the sale proceeds where these do not cover all claims. Registration of claim Alacak kaydı, iflas eden borçludan alacaklı olanların, ilanda belirtilen süre içinde alacaklarını belgeleriyle birlikte iflas dairesine bildirerek tasfiyeye katılmalarını sağlayan işlemdir. Removal of objection (summary procedure) A summary route allowing creditors holding qualified documents to have the debtor's objection set aside by the enforcement court. Request for enforcement Takip talebi, alacaklının icra dairesine başvurarak borçluyu, alacak miktarını ve takip yolunu gösterdiği ve cebri icra sürecini resmen başlatan yazılı ya da sözlü istemdir. Request for sale Satış talebi, haczedilen malın paraya çevrilmesi için alacaklının ya da borçlunun kanuni süre içinde icra dairesine yönelttiği ve satış sürecini başlatan istemdir.

State of insolvency Aciz hâli, borçlunun haczi kabil malvarlığının takip konusu borcu karşılamaya yetmediğinin icra dairesince tespit edilmesi ve bu durumun aciz vesikasıyla belgelendirilmesi hâlidir.

T

Third-party ownership claim İstihkak iddiası, haczedilen mal üzerinde borçlu dışında bir kişinin mülkiyet veya rehin gibi bir hak ileri sürerek haczin kaldırılmasını talep etmesidir. Third-party ownership claim The lawsuit by which a third party claiming ownership or a pledge over attached property seeks release of the attachment.

V

Valuation of attached assets The determination of the value of attached assets before sale, carried out by the enforcement office with expert assistance where needed.

W

Wage garnishment The seizure of a statutorily capped portion of the debtor's wages through a notice to the employer, with the deductions passed to the creditor.
